Terms of Service

1. Acceptance of Terms

By accessing the website business-ocean.us or engaging Business Ocean for any digital marketing services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.

2. Services

Business Ocean provides digital marketing services including, but not limited to:

  • Search Engine Optimization (SEO)
  • Social Media Management (SMM)
  • Pay-Per-Click Advertising (PPC / Google Ads)
  • Web Design and Development
  • UX/UI Design
  • Business Process Automation

The specific scope, deliverables, timelines, and pricing for each engagement are defined in a separate service agreement or proposal provided to the client.

3. Client Responsibilities

The client agrees to:

  • Provide accurate information required to perform the services
  • Grant necessary access to website platforms, analytics accounts, and advertising accounts as required
  • Respond to requests for approvals, content, or feedback within agreed timeframes
  • Pay invoices in accordance with agreed payment terms
  • Ensure all content provided to Business Ocean does not infringe third-party intellectual property rights

4. Payment Terms

Payment terms are specified in each service agreement. Generally:

  • Monthly retainer services are billed at the start of each month
  • Project-based work may require a deposit (typically 50%) before work begins
  • Invoices are due within 14 days of issuance unless otherwise agreed
  • Late payments may result in suspension of services

5. Intellectual Property

Client content: All content, logos, trademarks, and materials provided by the client remain the property of the client.

Deliverables: Upon full payment, Business Ocean assigns ownership of all deliverables (website designs, content, etc.) created specifically for the client to the client.

Tools and methodologies: Business Ocean retains ownership of its proprietary tools, processes, templates, and methodologies used in delivering services.

6. Confidentiality

Both parties agree to keep confidential any proprietary information, strategies, data, or trade secrets shared during the engagement. This obligation survives the termination of the service agreement for a period of 2 years.

7. Results Disclaimer

While Business Ocean strives to deliver the best possible results, we cannot guarantee specific rankings, traffic levels, or revenue outcomes. Search engine rankings depend on many factors outside our control, including Google algorithm changes, competitor activity, and the client's industry. We commit to applying best practices and transparent reporting throughout the engagement.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Business Ocean shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our services or website. Our total liability for any claim shall not exceed the total fees paid by the client in the 3 months preceding the claim.

9. Termination

Either party may terminate a service agreement with 30 days written notice. Upon termination:

  • All outstanding invoices become immediately due
  • Business Ocean will provide the client with all deliverables completed up to the termination date
  • Access credentials will be transferred back to the client

10. Website Use

You agree not to use this website to:

  • Transmit spam, malware, or harmful content
  • Attempt to gain unauthorized access to any systems
  • Scrape, copy, or reproduce website content without permission
  • Engage in any activity that violates applicable laws

11. Governing Law

These Terms of Service are governed by the laws of the United States. Any disputes arising under these terms shall be resolved through binding arbitration or in the courts of competent jurisdiction in the United States.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes take effect upon posting to the website. Continued use of our services after such changes constitutes acceptance of the new terms.
